Terms Of Service

Please Read ALL items before inquiring about commissions. By commissioning me you are agreeing to my terms of service.The following are my Terms of Service as of July / 12 / 2020 (Typed into this site as of: March / 22 / 2022.) And will remain in effect until otherwise stated or changed, except in the event of sales in which specific other terms or prices will be provided. Any new addendum or corrections will be dated and listed.
ALL commissions accepted before the posting of these new installments are not obligated to follow the terms stated, and instead the previous terms of service and pricing in affect at time of order will be honored. The same can be said for adopts & designs sold prior to the posting of the new Design TOS.COMMISSIONS
Please have a clear reference or image of the character(s) you wish to have drawn. Ref Sheets are preferred, but an unshaded image will be accepted. For best and most accurate design portrayal, please send images via email.Please list any emotions, poses or themes you would like displayed in your commission. | Please also state the type of commission you are wanting; Tid-Bit, Fullbody, flatcolors or full backgrounds etc. This helps accurately price your commission. NOTE: complex characters, items, and clothing will change the price of the commission.If you are purchasing a reference commission you MUST have an image of the character who's ref I'm making ready. (Original adopt images/ concept sketches etc.) I will NOT design the character and make the reference unless also being commissioned for a design.
3/22/22 Please have any changes you wish to have made between this image and the reference sheet ready and explained during ordering.I do not have a waitlist, and do not 'hold' commission slots for others; friends, family or otherwise.I specifically DO NOT draw anything NSFW. I will not draw extreme gore. Likewise, I will refuse commissions involving misconduct or abuse. I will not draw anything involving hate speech, hate symbols, or derogatory remarks etc. (People who request these kinds of commissions - in regards to hate speech & symbols etc- will be blocked.)I DO NOT MAKE NFTs. My work should never, for any reason under any circumstance, be used to make an NFT. Using my work without permission is breach of contract if made by a commissioner or other such owner of the artwork. Use of my work without permission is a form of theft and will be dealt with as such. | to help protect my customers, and myself, any NFTs found using my art will be reported and makers will be made aware of the theft promptly. Please just be decent humans and use your own work for your own buisness.All completed commissions will be emailed, or sent via other online means. I will NOT mail physical copies. (You are free to print your own or have them printed for personal use, but I do not offer this service.)If you back out of a commission, I will either use the sketch as a YHH for others to purchase or use it in personal work. After refunds are given, you have no claim to the sketch. All likeness to your OC(s) will of course be changed, except for species.While working on your commissions, I will send you WIPS (work in progress shots) for approval in stages: Sketch, Lineart, Coloring, and Background (if applicable) Durring these stages you may request changes and alterations. Changes will not be made after approval. For refunds, please see the refund policy.The following addenda have been added as of March / 22 / 2022.As art has become my current full time position, my former 'Hours' of work have changed from after work and on weekends to being from 10:00 AM - 5:00 AM Central Time.DESIGNS
The following is in regards to designs I make as adopts and customs, as well as personal characters I design and choose to sell later. This does not count towards designs I owned but did not design.All adopts are sold 'As-Is'. Meaning I will not offer changes to the design to be made, though you are free to make changes to fit your liking. 3/22/22 You may commission others to 're-design' characters I have designed. (Always ok but thought I'd state it.)You must credit me when reposting the design, or credit me in the reference as the designer. (If you pay someone to redesign the character, you may credit them for the redesign, but please still credit me for the original design. <3)If I am making you a custom, it will be done on pre-made lines that I have drawn myself. I accept mood-boards, and color pallets, but I will not create designs based on - or color pick from- other people's designs or private pallets. I do not offer changes to the entire basecoat once it has been approved. If you choose to be refunded You will be refunded based on the Refund Policy. (written below) After being refunded you will have no say over the design. I may choose to keep it or complete it and resell it as an adopt. You may not send my WIPS to another artist to complete the design. 3/22/22 As with every commission, special exceptions can be made. If i'm designing an oc based on a pet, or very sentimental theme etc. I WILL change it drastically before I resell.Please notify me if you are selling my designs.The following Addenda have been added as of March / 22 / 22.When reselling, you may not 'Flip' my designs for more than you originally purchased it for without additional art of the design. (I DO include art made by those selling the design.) You do not need to 'verify' prices with me before selling, just please be honest. If you are caught 'flipping' my designs twice you will be blacklisted from all of my commissions and owning my designs in the future.I do not allow my designs to be used in Breeding grids/ charts or foal memes.You may not sell "breeding slots" to my designs. (NOT including Breeds and species! You may sell slots to Mythlallahns, EPDs etc. as the breed or group allows.)REFUND POLICYI currently only accept payment through PayPal. USD (US Dollars) only.Payment is expected to be paid upfront before I begin on your commission. Note: Please select 'Goods and Services' and 'No Address Needed' on PayPal before sending payment. If not selected I will issue a refund and request these changes be made.I will issue refunds for: Terminated Commissions on the grounds of poor behavior, stolen characters & designs etc. (In the event of a stolen character, I will issue a refund and art will be delivered to the proper owner instead. If the art was already sent to commissioner, I will request removal of any postings of the work. If warning are needed, I will post one.)I will issue a FULL REFUND if: you request it and the commission has not been started.If I have already started your commission, I will subtract the price of the work I have already completed from your payment and refund you the remaining balance. (If a commission was $100 , and the sketch layer was completed, if sketches are $10 you would receive a $90 refund.)I will not issue refunds if the commission was completed.If the character you have commissioned me to draw was sold, I will send the image to the new owner -if requested- other wise I will email it to the original commissioner.If you have sold the character I was commissioned to draw and I have already started, I will not change the image to a new character and will not issue a full refund, as stated above.3/22/22 If you have sold a character I was commissioned to draw, and added the cost of the commission into sale I will not change the drawing to another character even I have yet to start.

I do accept commissions for T-Shirt designs, Logos, Mascots, and Character Design for company projects. My TOS remains about the same, but in the situation of character designs that may or may not be featured in Media or Art books, I will request credit be given where its due.
